Acceptable Use Policy for Zenphi

1. Introduction 

This Acceptable Use Policy (“Policy”) governs the use of all services and products provided by Zenphi Pty. Ltd. (“Zenphi”), including our software-as-a-service platform, websites, APIs, and any related services (collectively, the “Services”). This Policy outlines acceptable and prohibited activities to ensure a secure and efficient environment for all users. Violation of this Policy may result in suspension or termination of your access to the Services. We reserve the right to modify this Policy as necessary. Terms used but not defined in this Policy have the meaning set forth in the agreement (such as Zenphi’s Terms of Service or a master subscription agreement) between you (and/or your organization) and Zenphi that governs your use of the Services (“Terms”).

 

2. Compliance and Restrictions 

You agree not to engage in, or assist others in engaging in, the following activities:

  1. Unauthorized Access or Use: Attempting to access any part of the Services without proper authorization, including sharing login credentials inappropriately.
  2. Bypassing Security: Attempting to bypass or circumvent security mechanisms, including through reverse engineering, vulnerability testing, or evading filtering capabilities, is prohibited. This does not apply to Zenphi’s authorized bug reporting programs.
  3. Misuse of Services: Using the Services for any illegal or unethical purpose, or in a way that harms Zenphi or its users.
  4. Fake Engagement: Creating, promoting, or publishing artificial or inauthentic engagement, reviews, or other related content is prohibited.
  5. Spamming: Generating or sending unsolicited messages without proper consent, or in violation of applicable laws, is prohibited.
  6. Reverse Engineering: Attempting to reverse engineer, decompile, or otherwise derive the source code or underlying ideas or algorithms of any part of the Services, except as permitted by law.
  7. Interference and Overload: Interfering with the operation of the Services, including overloading, flooding, spamming, or creating an undue burden on the Services.
  8. Harmful Conduct: Engaging in conduct that is harmful, fraudulent, deceptive, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another’s privacy, or is otherwise objectionable.
  9. Misrepresentation: Impersonating others, engaging in phishing, spoofing, or misrepresenting your identity or the origin of any content is prohibited
  10. Exploitation of Minors: Using Zenphi’s Services to exploit minors or their images, likenesses, or recordings is strictly prohibited.
  11. Intellectual Property Violation: Infringing or misusing Zenphi’s or any third party’s intellectual property rights.
  12. Data Mining and Scraping: Using automated systems, such as robots, spiders, or scrapers, for data mining or scraping purposes on the Services.
  13. Competitive Use: Using the Services in any manner that is to Zenphi’s detriment or competitive disadvantage, or for the purpose of developing competing products or services.
  14. Disrupting Uptime: Engaging in activities that adversely impact the availability or performance of our Services, or the services offered by third parties, is strictly prohibited.
  15. Denial of Service: Creating or posing a risk that could result in a denial of service attack on our Services or those of a third party is prohibited.
3. Responsibility and Enforcement
    1. User Responsibility: You are solely responsible for your use of the Services and any consequences arising from such use. This includes ensuring that your activities comply with this Policy, applicable laws, and regulations. You must adhere to Zenphi’s internal security measures and relevant data protection laws, including but not limited to GDPR, HIPAA, or equivalent regulations applicable in your jurisdiction. Additionally, you are responsible for designing and implementing your automations using best practices, and for securing and protecting any sensitive information processed through Zenphi’s Services by applying adequate security measures. Failure to comply may result in actions such as the suspension or termination of your access to the Services.
    2. Enforcement Measures: Zenphi reserves the right to investigate and prosecute violations of this Policy to the fullest extent of the law. We may involve and cooperate with law enforcement authorities in prosecuting users who violate this Policy. Violations of this Policy may result in actions including, but not limited to, the suspension or termination of your access to the Services. Each violation is reviewed on a case-by-case basis. Depending on the severity, Zenphi may request that you address the issue, or temporarily or permanently suspend or terminate your account.
4. Fair Use Policy Compliance
Users of Zenphi’s Services must comply with the Fair Use Policy, which outlines the resource allocations and usage limits applicable to each subscription tier. The Fair Use Policy is an integral part of this Acceptable Use Policy and governs acceptable usage to ensure equitable and optimal performance for all users. Any violation of the Fair Use Policy may result in enforcement actions, including access restrictions, additional charges, or termination of Services. 5. Changes to the Policy 

Zenphi may revise this Policy from time to time. We will post any changes on our website, and the changes will become effective immediately upon posting. By continuing to use Zenphi’s Services after an update, you agree to the modified Policy. If you disagree with the changes, your sole remedy is to discontinue using the Services.
